1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, websites, booking systems, communications, events, classes, workshops, consultations, and related offerings provided by Maple & Hearth Culinary Studio (“Maple & Hearth Culinary Studio,” “we,” “us,” or “our”).

By booking, attending, purchasing, accessing, or otherwise using any service offered by Maple & Hearth Culinary Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional policies, waivers, instructions, or event-specific terms provided to you. If you do not agree to these Terms, you must not use our services.

These Terms are intended to apply to consumers and business clients in Canada and shall be interpreted in accordance with applicable Canadian federal and provincial laws, including consumer protection, privacy, and contract laws, as applicable.

2. Scope of Services

Maple & Hearth Culinary Studio provides culinary education, food-related experiences, and related consulting services, which may include, without limitation:

We reserve the right to modify, substitute, or discontinue any service, class format, ingredient, recipe, instructor, or venue at any time, subject to applicable law and any confirmed booking terms.

3. User Obligations and Responsibilities

By using our services, you agree to the following obligations:

You acknowledge that participation in culinary activities is voluntary and that you are responsible for determining whether you are fit to participate. If you have a severe allergy or medical concern, you should consult a qualified medical professional before attending and notify us in advance so we can assess whether reasonable accommodations are possible.

4. Payment Terms and Conditions

Unless otherwise stated in writing, all fees are quoted in Canadian dollars (CAD) and are subject to applicable taxes, including GST/HST and any other required taxes.

We reserve the right to change pricing at any time before a booking is confirmed. Once a booking is confirmed, the agreed price will apply unless the scope of services changes by mutual written agreement or as otherwise permitted by these Terms.

5. Cancellation and Refund Policy

Cancellation and refund terms may vary depending on the service type, booking size, venue, ingredients purchased, staffing commitments, and lead time. Unless a separate written agreement applies, the following general policy will govern:

Refunds, if approved, will generally be issued to the original payment method within a reasonable period. Any non-refundable third-party costs, special-order ingredients, custom materials, or venue fees may be deducted where permitted by law and disclosed in advance or in the applicable booking terms.

Nothing in these Terms limits any non-waivable consumer rights under applicable Canadian law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple & Hearth Culinary Studio, its owners, directors, officers, employees, contractors, instructors, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of business, loss of data, or loss of goodwill, arising out of or related to your use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by you to Maple & Hearth Culinary Studio for the specific service giving rise to the claim, or CAD $100, whichever is greater, except where such limitation is prohibited by law.

We do not guarantee that any recipe, technique, food outcome, or result will meet your expectations or be suitable for your particular needs. Culinary results may vary based on skill, equipment, ingredients, and other factors.

You acknowledge and accept that food preparation and kitchen activities involve inherent risks, including but not limited to burns, cuts, slips, allergic reactions, choking, foodborne illness, and property damage. You participate at your own risk, except to the extent caused by our negligence or willful misconduct.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, intentional misconduct, or any mandatory statutory consumer protections.

7. Intellectual Property Rights

All content, materials, designs, lesson plans, recipes, handouts, photographs, videos, branding, logos, trade names, text, graphics, and other intellectual property provided by or on behalf of Maple & Hearth Culinary Studio are owned by or licensed to Maple & Hearth Culinary Studio and are protected by applicable intellectual property laws.

If you provide us with feedback, suggestions, testimonials, or ideas, you grant Maple & Hearth Culinary Studio a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display such submissions for business, marketing, training, and operational purposes, subject to applicable privacy laws and any agreed confidentiality obligations.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy legislation.

Personal information may be collected for purposes such as booking management, payment processing, customer service, dietary accommodation, safety, marketing communications, legal compliance, and service improvement.

9. Force Majeure

We shall not be liable for any delay, interruption, failure, or inability to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, pandemic, epidemic, public health emergency, labour disruption, power outage, supply chain disruption, transportation failure, government action, venue closure, civil unrest, terrorism, or equipment failure not caused by our negligence.

In the event of force majeure, we may, at our discretion, reschedule the service, provide a credit, modify the service, or cancel the affected booking. Any refund or credit will be determined in accordance with applicable law and the circumstances of the event.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, operational practices, or other business needs. The updated Terms will be posted or otherwise made available with a revised effective date.

Your continued use of our services after the updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by law. If you do not agree to the updated Terms, you must stop using our services and, where applicable, contact us regarding any outstanding bookings.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of our offerings shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection rights or other non-waivable legal rights, you agree that the courts located in Ontario, Canada shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or our services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, unenforceable, or contrary to applicable law by a court or other competent authority, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect to the fullest extent permitted by law.

Any failure by Maple & Hearth Culinary Studio to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless expressly stated in writing.

By booking or participating in any service offered by Maple & Hearth Culinary Studio, you acknowledge that you have read and agree to these Terms of Service.
